Introduction

These General Conditions of Use, Conditions of Sale and Privacy Policy regulate the use of the website, www.uecornella.cat, of which UE CORNELLÀ SAD is the owner.

UE CORNELLÀ SAD is a Spanish company with registered office at ADREÇAEMPRESA, CIUTATEMPRESA, and CIF number NIFEMPRESA.

Article 1. Purpose

These Conditions establish the rights and obligations of all users of UE CORNELLÀ SAD, in relation to the products and services that we offer through our website www.uecornella.cat.

We ask you to carefully read both these Conditions and our Privacy Policy before confirming your payment to place the order.

By using the website www.uecornella.cat or placing an order through it, you are bound by these Conditions and our Privacy Policy, so if you do not agree with all the Conditions and the Privacy Statement, you should not place any order.

These Conditions could be modified, so you must read them before placing each order.

Article 2. Prices

The prices listed on www.uecornella.cat are expressed in euros and include all current taxes. Therefore, they are final prices and will only be increased, in the purchasing process, by the transportation costs that correspond according to destination.

The price is expressed with current taxes included, and at the value defined at the time of acceptance of the purchase. The price must be paid in full to make the purchase.

Prices do not include shipping costs, which will be added to the total amount of the cart.

UE CORNELLÀ SAD reserves the right to modify the sales prices that appear on www.uecornella.cat at any time, but the value to be applied in the sale will be the one that appeared at the time of the commercial transaction (check-out).

European Union, Canary Islands, Ceuta and Melilla.

For orders coming from the European Union by companies that are registered in the register of intra-community operators, VAT will be deducted from the products and transport costs.

For orders invoiced to the Canary Islands, Ceuta and Melilla, VAT will be subtracted from the products and transport costs. This deduction will be made automatically on our website, at the end of the purchasing process.

Tariffs, customs clearance, costs and local taxes of countries or communities will be paid at destination by the client, if any, according to the local legislation of each area.

Article 3. Payment Methods

  The customer can choose to pay by credit card, the operation being carried out at the time of placing the order.

  At www.uecornella.cat the system called SSL (Secure Sockets Layer) is used, a payment system in a secure environment since it allows the encryption of the information transmitted during the transaction, ensuring its confidentiality.

Article 4. Availability

• Geographical availability: The items offered through this website will only be available in Peninsular Spain, the Balearic Islands and Peninsular Portugal. (##for example, specify a specific case)
• Product availability: CUSTOMER will make every effort to satisfy its customers’ requests. But all product orders are subject to their availability and, in this sense, if there are difficulties regarding their supply, or if there are no items in stock, we reserve the right to provide you with information about substitute products. If you do not wish to order such substitute products, we will refund any amount you may have paid.

Article 5. Shipping and Delivery Times

UE CORNELLÀ SAD undertakes to deliver the products in perfect condition to the delivery address that you indicate in the order form.

You can request delivery of the items to another address and to another natural person other than the one signing the order, as long as the delivery address is located within the area of operation defined in the conditions of sale (article 4: Availability).

In order to optimize delivery, we appreciate that you indicate an address to which the order can be delivered within normal business hours.

The delivery of the merchandise will be made to the address designated by you. In the event of the recipient’s absence, at the time of delivery, a receipt will be left indicating how to proceed to arrange a new delivery.

UE CORNELLÀ SAD reserves the right to vary the type of shipment and the company by which it is carried out, regardless of what is stated on these pages and as long as it does not entail obvious detriment to you.

The shipping costs derived from the shipments of the purchased items will be reflected at the final moment of the purchase and will depend on the chosen modality, urgent or normal, and the destination. These conditions may be modified.

For the purposes of these Conditions, it will be understood that “delivery” has occurred or that the product(s) have been “delivered” at the time of signing for receipt of the same at the agreed delivery address.

We will understand these delivery times on business days (Monday to Friday) and for orders placed on www.uecornella.cat before 2 p.m.

There may be products whose delivery times are different from those specified in these conditions. In this case, the delivery times for them will be correctly specified in your file.

These deadlines are averages, and therefore an estimate. Therefore, it is possible that they vary for logistical reasons or force majeure.

If for any reason we cannot meet the estimated delivery date, we will inform you of this circumstance and give you the option of continuing with the purchase by establishing a new delivery date or canceling the order with a full refund of the price paid. Please note in any case that we do not deliver on Saturdays or Sundays.

Unable to deliver:

We reserve the right to withdraw any Product from our website at any time and/or to remove or modify any material or content thereon. Although we will do our best to always process all orders, there may be exceptional circumstances that require us to refuse to process an order after we have sent the Order Confirmation, and we reserve the right to do so at any time, in our sole discretion.

We will not be liable to you or any third party for removing any product from our website www.uecornella.cat, regardless of whether said product has been sold or not, removing or modifying any material or content on the website, or for refusing to process an order once we have sent you the Order Confirmation.

The cost of shipping the complete order is €4.99. Normal shipments are made the day after confirmation or payment, and are sent through the transport company, with a delivery time between 1-3 days.

Failure to meet deadlines

In case of non-compliance with the delivery times in the express service, we will proceed to refund the amount of the shipping costs, through a compensation voucher, as long as the causes of the delay are not derived from incorrect address or absence of the recipient.

Article 6. Order

The fact of placing an order on www.uecornella.cat is equivalent to full and complete acceptance of the prices, the description of the products for sale and the general conditions of sale, which will be the only ones applicable to the contract thus concluded.

You agree, when placing the order, to provide us with an email address, postal address and/or other contact information, and you are aware that we may use this information to contact you if necessary (see our Privacy Policy).

If you choose a credit card as a means of payment, when placing an order on www.uecornella.cat, you guarantee that you are fully authorized to use it. Only people with the necessary legal capacity to sign contracts related to the type of goods and services proposed on this website can place orders on www.uecornella.cat.

To place an order, you must follow the online purchase procedure until payment.

After this, you will receive an email acknowledging receipt of your order (the “Order Confirmation”). This does not imply that your order has been accepted, since it constitutes an offer that you make to us to purchase one or more products. All orders are subject to our acceptance and we will confirm such acceptance to you by sending you an email confirming that the product(s) are being dispatched (the Dispatch Confirmation). The contract for the purchase of a product(s) between us (Contract) will only be formalized when we send you this Shipping Confirmation.

Only those products listed in the Shipping Confirmation will be the subject of the Contract. We will not be obliged to supply you with any other products that may have been ordered until we confirm their shipment to you in a separate Shipping Confirmation.

Article 7. Guarantee of purchased products

In accordance with Royal Legislative Decree 1/2007 of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users, UE CORNELLÀ SAD is responsible for any lack of conformity that appears within a period of two years from delivery.

In the case of lack of conformity, you must inform us within two months of becoming aware of it, by sending an email to info@uecornella.cat indicating your details, the number of your purchase invoice and the anomaly detected. In the case of a manufacturing defect, UE CORNELLÀ SAD will be responsible for the return costs, as well as expenses related to labor and materials.

The item to be returned must be properly packaged for its return. The packaging must be in perfect condition and retain all its original accessories and instructions in order to be returned.

The instructions for the correct use and installation of the product, as well as the warranty documentation included by the manufacturers, are mandatory for the buyer to read.

The warranty will lose its validity in the event of defects or deterioration caused by external factors, accidents, especially electrical accidents, wear, installation and use not in accordance with the Supplier’s instructions.

Products modified or repaired by the customer or any other person not authorized by the supplier are also excluded from the warranty.

Article 8. Return Policy

Returns in exercise of the right to withdraw from the purchase

All products purchased at www.uecornella.cat may be returned and refunded, provided that you inform us of your intention to return the purchased product(s) within a maximum period of 14 business days from the delivery date and that the rest of the conditions established in this section are met.

UE CORNELLÀ SAD will only accept returns that meet the following requirements:

1. The product must be in the same condition in which it was delivered and must retain its original packaging and labeling.
2. Shipping must be made using the same protective cardboard box in which it was received to protect the product. In the event that you cannot obtain the protective box with which it was delivered, you must return it in a protective box so that the product arrives at the UE CORNELLÀ SAD warehouse with the maximum possible guarantees.
3. A copy of the delivery note must be included inside the package, where the returned products and the reason for the return are also marked.

After examining the item, we will inform you if you are entitled to a refund of the amounts paid for the item(s) purchased. Only the amount of the item(s) will be refunded, never the shipping, refund and gift packaging costs.

The return will be made as soon as possible and, in any case, within a period of 30 days from the date on which you notified us of your intention to withdraw. The refund will be made on the same credit card that was used to pay for the purchase, in the case of Card purchases or by bank transfer, for cash on delivery orders, to an account where the owner of the account is the person who placed the order, this data must be sent by the customer by email. You will assume the cost and risk of returning the products to us, as indicated above.

No exchange or return will be made for those products that are not in the same conditions in which you received them, or that have been used beyond the mere opening of the product or those personalized items.

This provision does not affect the rights recognized by the consumer under current legislation.

Returns of defective products

In cases in which you consider that at the time of delivery the product does not comply with what is stipulated in the Contract, you must contact us immediately through our contact form at www.uecornella.cat or info@uecornella.cat, providing data on the product as well as the damage it suffers, in some cases we will request that you send us a photo of the damage.

Once the notification has been received at UE CORNELLÀ SAD, we will contact you to inform you how you should proceed, and by which courier agency you should do it. As a general rule, these are the steps to follow:

You must return the product to the address indicated on the invoice that you will receive by mail, providing us with the following information:

5. Order receipt date
6. Return date

Please return the item using its original packaging as well as any instructions, documentation and packaging that may accompany it.

Once we receive the merchandise to be returned, we will proceed to carefully examine the returned product and we will inform you by e-mail within a reasonable period of time whether it should be returned or replaced (if applicable). The return or replacement of the item will be made as soon as possible and, in any case, within 30 days following the date on which we send you an email confirming that the return or replacement of the non-conforming item is appropriate.

In the event that the product(s) cannot be replaced, the amounts paid for those products that are returned, due to any defect or defect, when it really exists, will be fully refunded, including the delivery costs incurred to deliver the item to you and the costs that you would have incurred to return it to us.

Partial returns and cancellations will give rise to partial refunds of the total amount paid for the entire order. Transportation, refund and gift packaging costs will not be refunded in case the return is partial.

The refund will be made to the same credit card that was used to pay for the purchase or by bank transfer for orders paid by refund.

Article 9. Liability and exemption from liability

The photographs and texts reproduced that present the products offered are for informational purposes only.

The liability of UE CORNELLÀ SAD in relation to any product purchased on www.uecornella.cat will be strictly limited, in any case, to the purchase price of said product and will not be compromised by simple errors or omissions that may have taken place, when all necessary precautions have been taken in the presentation of the products.

UE CORNELLÀ SAD cannot be held responsible for damages, whatever their nature, whether material, non-material or bodily, that may result from improper operation or use of the products marketed. The same applies to possible modifications made to the products by suppliers.

UE CORNELLÀ SAD cannot be held responsible by a client or a third party for indirect damages, operating losses or loss of profits occurring by any means whatsoever even if said damage, loss or harm had been foreseen by UE CORNELLÀ SAD or if its eventuality had been brought to its attention.

Subject to the provisions of the preceding paragraphs, the liability of UE CORNELLÀ SAD under these general conditions may not exceed an amount equal to the sums paid after the transaction that is the origin of said liability, regardless of the cause or form of the action in question.

UE CORNELLÀ SAD cannot be held responsible for non-compliance with the contract signed in the event of stock depletion or unavailability of the product, due to force majeure, interruption of activity or total or partial strike, especially in postal services and means of transport or communications, floods or fire.

The provisions of this clause will not affect your rights recognized by law as a consumer, nor your right to withdraw from the contract.

In case of dispute, the client may first contact UE CORNELLÀ SAD to reach an amicable resolution.

Article 10. Notifications

The applicable regulations require that part of the information or communications we send you be in writing. By using the website www.uecornella.cat, you agree that most communications with us will be electronic.

We will contact you by email.

For contractual purposes, you consent to the use of this electronic means of communication and acknowledge that all contracts, notices, information and other communications that we send to you electronically comply with the legal requirements of being in writing. This condition will not affect your rights recognized by law.

The notifications that you send us should preferably be sent through our contact form. In accordance with the above provisions and unless otherwise stipulated, we may send you communications either to the e-mail or to the postal address provided by you when placing an order.

Article 11. Applicable legislation and jurisdiction

These General Conditions are governed by Spanish law.

The parties submit, at their option, for the resolution of conflicts and waiving any other jurisdiction, to the courts and tribunals of Barcelona.
